1. Acceptance of Terms

By accessing or using NimbusLearn ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a school or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

NimbusLearn is a learning management system that provides tools for managing grades, attendance, communication, content delivery, and other educational functions for schools. The Service is accessible via web browsers and native mobile applications.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. Schools are responsible for managing user accounts and access levels within their organization.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service's infrastructure
  • Upload malicious code or harmful content
  • Share account credentials with unauthorized users
  • Use the Service to harass, abuse, or harm others

5. Data Ownership

Schools retain full ownership of all data entered into the platform, including student records, grades, attendance data, and uploaded content. NimbusLearn does not claim ownership of your data and will not use it for purposes other than providing the Service.

6. Security

We implement industry-standard security measures including AES-256 encryption, SSL/TLS, role-based access controls, and regular security audits. While we strive to protect your data, no method of transmission over the internet is 100% secure.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. Enterprise customers receive SLA guarantees as specified in their service agreements.

8. Payment Terms

Subscription fees are billed monthly or annually as selected. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' advance notice.

9. Termination

Either party may terminate the subscription with 30 days' written notice. Upon termination, we will provide a reasonable period to export your data. After the export period, data will be permanently deleted.

10. Limitation of Liability

To the maximum extent permitted by law, NimbusLearn shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the platform or via email. Continued use after changes constitutes acceptance.
